Yes, it’s hot! Makes me feel like I’m paying rent for a place in Hell. I would feel a lot better if someone would turn the heat down just a lot. I think it’s going to be just under 200* this weekend. The key is drink lots of water and be safe in what you do. This heat is no joke, especially for you Central and Northern agents, just pay attention to how you feel and act accordingly.
I want to remind agents that all listings and buyer broker agreements are owned by the Principal Broker. I remind you of this because I have seen more and more clients wanting to ditch their agent for some fabricated reason, usually because someone offered a better deal if they do. When that happens, and it will sometime. Make that be your excuse (I need to involve my Broker as they are the real representative for you). It takes the heat off you and sometimes they don’t want to deal with the broker. That will not mean that we can fix whatever is going on but at least we can try. Call with any questions.
I have been doing some CE online for license renewal. As I was going over Contract Law it reminded me about some important items we seem to ignore. I have seen in addendums the phrase “Property shall be sold AS IS”. I want to remind everyone that this will not release the seller or you from disclosing pertinent defects known about the property. You will also need to tell the seller that. The other item I see at times is “No seller's disclosures shall be provided”. 99.9% of the time the seller and the agent meant that to be just for the SPCD. If you remove the “Sellers Disclosures” that would remove all of section 7 of the REPC, you don’t want to do that. Read section 7 of the REPC and you will better understand the importance of just removing Section 7.a of the RECP from the contract, and not the entire section by mistake.
Last item of the week. If anyone looked at the list of fair housing words “Not to use” then compared them to what is posted on the MLS it would shock you. Often it is just not knowing what words violate fair housing. Please take a little time and look at the LIST, it is lengthy. Words that you never think about are violations, I believe you’ll be surprised. Please call with questions.
