Buyer Broker and the Listing Agreements

I have seen some issues with the Buyer Broker and the Listing agreements lately.

Looks like rain and we sure need it. At least the heat has gone down a little bit. With any luck we’ll all get a little rain. The 24th of July nearly guarantees rain in the State somewhere.

I missed last week's bits but I’m sure you forgive me. Not many items to go over this week so let me begin. I have seen some issues with the Buyer Broker and the Listing agreements lately. We are getting better about the dates in section 1 of the agreements being the ending date, not the start date. I have noticed that a few agents have used the Non-Exclusive Buyer Broker Agreement of the Non-Exclusive Listing Agreement. I understand why, because you do business in more than one County. Please don’t use Non-Exclusive forms; it lets the client enter into another agreement with another agent with no recourse for you. I feel that under any circumstance it would be appropriate to use the Exclusive Buyer Broker or Exclusive Right to Sell. In the place of an area like County please write in that spot “All of the State of Utah”.  I feel that you don’t need to put an address in the area either as it binds you to that property only, and again the client could move on to another property with another agent with no recourse.
