I have a few items I want to go over with all of you this week. I need to remind agents that Earnest Money is less than $5,000. Needs to be deposited with the Title Company of your choice unless it is a cash deal then the seller chooses title. With the amount of business going on it will expedite your full check when it closes. If for some reason the client insists the brokerage hold it, we will.
I have been faced with some interesting issues this week. I have needed to talk with other brokers about their agents calling our buyers lenders, as if they have the right to. The Division has an interesting take on this practice, and it pertains to the lender that is called. The only ethical question that an agent other than the client’s agent can ask is “Are you the author of the pre-qual or pre-approval letter”? That is the only question the lender can answer without risking their license, because all information shared between the buyer and the lender is confidential. Without the written permission from the buyer the listing agent has no business calling a buyer’s lender for any information. Not only is it unethical it is extremely poor form. The contract, and the terms in it are evidence enough to show the intent of the buyer to purchase the property, and that’s not counting the earnest money they have put at risk if they fail to perform. I don’t believe that it's in the best interest of the seller to pry into someone's personal finances or for their agent to do so either. I’m much more concerned about the truth on the SPCD from the seller. Lately sellers seem to think they don’t need to be truthful because in this market “My home will sell anyway”. It is our duty to insist they are truthful and teach them about misrepresentation and the consequences of it.
This is from my desk asking for a favor from all of you. Please load your paperwork in the Transaction Room in the correct place. It pains me to send them back to you for that reason, so please load them in the right slots. I also understand to our new agents that it will take a little time to get the hang of the system.
We are nearing the end of an interesting year. I want to let everyone know that Red Rock is putting the programs in place to make the New Year extremely exciting. All of it geared to help our agents to make more money with less effort. It really is cool and will perform as promised.
